1. Introduction
These Terms and Conditions govern the use of the DigAccess Agrotourism platform (hereinafter "Platform") and constitute a legally binding agreement between the user and the Platform operator.
By using the Platform, the user fully accepts these Terms and Conditions. If you do not accept these Terms and Conditions, please do not use the Platform.
2. Content Rights
All rights reserved. All content present on the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data collections, and software, are the property of the Platform operator or its content providers and are protected by copyright laws.
By "All rights reserved" it means that, including but not limited to:
- You are not allowed to copy, reproduce, distribute, publish, publicly display, publicly perform, modify, adapt, translate, or create derivative works from the Platform content without explicit written authorization.
- You are not allowed to use the Platform content for commercial purposes without prior authorization.
- You are not allowed to remove, alter, or obscure any copyright, trademark, or other proprietary notice from the Platform content.
The user may view, download, and print content from the Platform exclusively for personal and non-commercial use, provided that they do not modify the content and retain all copyright and other proprietary notices contained in the original content.
3. Registration
Registration to the Platform is optional and not necessary to use the basic features of the application.
However, some advanced features may require registration. In such cases, the user is responsible for the confidentiality of their access credentials and all activities performed using their account.
4. Permitted Use
The user may use the Platform only for legal purposes and in accordance with these Terms and Conditions.
Prohibited uses include, but are not limited to:
- Using the Platform in a way that violates any applicable local, national, or international law or regulation.
- Using the Platform to transmit or facilitate the sending of unsolicited or unauthorized advertising or promotional material.
- Using the Platform to collect or store personal data of other users in relation to the prohibited conduct described above.
- Interfering with or disrupting the integrity or performance of the Platform or the data contained therein.
- Attempting to gain unauthorized access to the Platform, computer systems, or networks connected to it.
5. Privacy
The use of the Platform is subject to our Privacy Policy, which describes how we collect, use, and protect personal data. The Privacy Policy is an integral part of these Terms and Conditions and is available in the dedicated section of the Platform.
6. Applicable Law and Jurisdiction
These Terms and Conditions and any dispute or claim arising from or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with Italian law.
For any dispute arising from the application or interpretation of these Terms and Conditions, the Court of Milan shall have exclusive jurisdiction.
Exception for consumers: If the user is a consumer under the Italian Consumer Code, the applicable law and jurisdiction will be determined according to the mandatory legal provisions protecting consumers.
7. Changes to Terms and Conditions
We reserve the right to modify these Terms and Conditions at any time. The changes take effect as soon as they are published on the Platform. Continued use of the Platform after such publication will constitute acceptance of such changes.
